For the iphone 4 it has to be the old bootrom but for the 3gs it doesn't matter which boot rom you have new or old, but it does require shsh files to be saved previously. The Iphone i used had not been previously jailbroken it had only been updated TO 4.0.2 The iphone 4 downgrade will not work for some of you because it requires previously saved SHSH cydia files.
