Salt Lake City DUI Attorney -What Should I Do After a DUI Arrest

In this video, Matt Nebeker, a DUI Defense Lawyer in Salt Lake City, discusses the things that you should do after a DUI Arrest. "The most important thing to do after being arrested for a DUI is contacting an attorney. The quicker you contact the attorney the quicker we can start working on the case, getting hearings scheduled, getting the driver's license hearing requested and scheduled, getting the evidence gathered, obtaining the video, and just getting all the things we need to do to defend the case. Getting those into play, that's the most important thing. Sometimes people will just delay and they won't have the money or they think they don't have the money to go and fight this case. Sometimes they feel like they're hopeless. They feel like there are no defenses. They feel like "you know what I probably should be convicted for DUI. I was out on the road, I was drinking, I probably should be" but that's not always the case. I would say let the attorney look at the case. Contact the attorney. There may be payment options available. There may be defenses that the driver doesn't see or isn't aware of. If you've been charged with a DUI, time is of the essence. You need to call an attorney who is experienced, who's been through what you're going through, and that person is me -- Matt Nebeker, Mr. DUI." Matthew L. "A DUI is being in actual physical control of a vehicle with a blood alcohol concentration of .08 or higher. You can have a DUI if you have illegal or controlled substance in your system -- like marijuana, methamphetamines, I call them "street drugs" -- or if you're under a combination of any kind of prescription drug or alcohol that renders you incapable of safely operating your vehicle, you can be found guilty of DUI. If you've been charged with a DUI, time is of the essence. You need to call an attorney who is experienced, who's been through what you're going through, and that person is me -- Matt Nebeker, Mr. DUI." Matthew L. That's what I would do -- not that I drink and drive. But if I were pulled over, side of the road, the officer was investigating me for DUI, I would certainly submit to his request to do a chemical test. What Do I Do if I'm Charged with a DUI for My Prescription Drugs

In this video, Matt Nebeker, a DUI Defense Lawyer in Salt Lake City, discusses what you should do if you are charged with DUI for your prescription drugs. "Well if you've been arrested for DUI, the first thing you need to do is contact a DUI attorney. If you weren't drinking or don't have illegal substances in your system and you're arrested for DUI, that doesn't mean that the case is just going to be dismissed by the prosecutor. If you have some prescriptions in your system and they've taken your blood and those prescriptions have similar effects to those of alcohol, then the prosecutor can proceed on that. So yeah, just because you have prescriptions in your system and you have a valid prescription for those, that does not mean that your DUI is automatically go away. The prosecutor is going to look and see if you were impaired based on any kind of driving pattern or your performance on the field sobriety test. Just because they're legal drugs and you have a valid prescription for them doesn't mean that your DUI is going to go away. If you've been charged with a DUI, time is of the essence. You need to call an attorney who is experienced, who's been through what you're going through, and that person is me -- Matt Nebeker, Mr. DUI." Matthew L. Salt Lake City DUI Attorney - What is Utah's Open Container Law?

    by SaltLakeCityDUIAtty (7/28/12) 1 views

Salt Lake City DUI Attorney. Visit http://www.mrduiattorneysaltlakecity.com/ or call us at (801) 988-9617 for more DUI defense information in Salt Lake City, UT. In this video, Matt Nebeker, a DUI Defense Lawyer in Salt Lake City, discusses the open container law in Utah. "The open container law in Utah is pretty straight forward. You can't have an open alcoholic beverage in your vehicle. I've seen the police push this on different levels. I've seen some people that have gone and collected up aluminum cans -- got a back full of aluminum beer cans -- and they put those in a sack and put them in the backseat of their car and gotten stopped and the officers have given them citations for open containers. But the most times we see it is with a DUI charge. The person leaves their friend's barbeque or house party and they just want to finish off that one last drink so they'll put a beer in their console and kind of forget about it. Or they'll have a mix drink and put it in there and forget about it and then will get cited for that. That makes it a little bit more difficult to defend them on a DUI if they have an open container or an empty vodka bottle in the backseat of their car. But the law is pretty straightforward -- there are no alcoholic containers allowed. If you've been charged with a DUI, time is of the essence. You need to call an attorney who is experienced, who's been through what you're going through, and that person is me -- Matt Nebeker, Mr. DUI." Matthew L. In this video, Matt Nebeker, a DUI Defense Lawyer in Salt Lake City, discusses the legal DUI limit in Utah. "There are different legal limits to be over the limit in Utah. It depend on the age, it depend on if you're in a commercial vehicle or not, but the standard is .08 or higher. If you're .08 pr higher you are going to be, what they call per se, a DUI. People will drink. Some people have a high tolerance for alcohol and they will function well at a level above .08. That's where a lot of people get into trouble. They think they function well and they think they're okay to drive and they're doing well with their driving, but .08 is the law. It doesn't matter if they think they're doing well, if you're .08 or higher you're in violation of the law and you can be arrested for DUI. If you've been charged with a DUI, time is of the essence. You need to call an attorney who is experienced, who's been through what you're going through, and that person is me -- Matt Nebeker, Mr. DUI." Matthew L. Salt Lake City DUI Attorney - How Soon Should I Contact a Lawyer

In this video, Matt Nebeker, a DUI Defense Lawyer in Salt Lake City, discusses how soon should you contact a DUI Lawyer.. "If you get arrested for DUI, I would make that your second call. Once you get out of jail or get release to someone, your second call need to be to an attorney -- such as myself. The reason is because the clock is ticking. There are certain things that you have to do to defend your DUI. You have to submit or send in a request for a driver's license hearing within those 10 days. A lot of people wait a week or two before they contact their attorney because their court dates are sometimes set out a week or two. Then they go and contact the attorney after that and by that time it's difficult to get them their driver's license hearing because you have to send in that request within 10 days to get the hearing to try and save your driver's license from being suspended. If you've been charged with a DUI, time is of the essence. You need to call an attorney who is experienced, who's been through what you're going through, and that person is me -- Matt Nebeker, Mr. DUI." Matthew L. "I have been practicing as a DUI attorney going on 10 years now. I started in 2003 and one of my first cases was a DUI. It happened to be an acquaintance of mine, an old family friend, and it was his second offense. He needed some help or he was going to be in big trouble. We took the case to trial, we had a jury trial, and we won that case. It was in one of the justice courts. It was good experience. That's how I got my feel or my love for doing DUIs, just by working that first case, taking it to a jury trial, and actually winning. From then on I knew that DUI defense was what I wanted to do. If you've been charged with a DUI, time is of the essence. You need to call an attorney who is experienced, who's been through what you're going through, and that person is me -- Matt Nebeker, Mr. DUI." Salt Lake City DUI Attorney - Can I Be Arrested for DUI?

Salt Lake City DUI Attorney. Visit http://www.mrduiattorneysaltlakecity.com/ or call us at (801) 988-9617 for more DUI defense information in Salt Lake City, UT. In this video, Matt Nebeker, a DUI Defense Lawyer in Salt Lake City, discusses if you can be arrested for DUI if you are not driving. "What does it mean to be in actual physical control of the vehicle when it comes to DUI and DUI defense? Well actual physical control of the vehicle, there is some grey area in the law. There is some case law that helps us define what that means. But what I see a lot of times happening in my practice, is a married couple, for instance, they'll have an argument. They'll be at their house, they'll have been drinking, having a few drinks at their home. They might get in an argument later on in the evening. So to cool down, which is a good thing to do, one of them will go out into their car. They'll turn on the ignition and they'll play some music while they're calming down. This one case that I had, the guy turned his music a little too loud so his neighbor called the police on him. The police come, pull up. He's in his car, he's got the ignition on, and the radio is going. The officer -- after his investigation -- arrests him for DUI. Another case that I had that I see quite commonly is people will be in their cars, they will have had a few drinks. They will come to realize "I shouldn't be driving" so they will immediately pull over somewhere. We had one case where it was a young lady. She knew she shouldn't have been on the road. Once she got on the road and was driving she knew she shouldn't have been on the road. So she goes and pulls into a store, parks the vehicle, and lies down on the seat to get some rest and to sober up, to get right. She didn't have anyone to call. So she's lying there. The officers see her car and they go and -- in this particular case -- they considered that a suspicious vehicle. The business was closed. These officers in these smaller communities get to know the businesses and what cars are around, so this was something he considered a suspicious vehicle. He went and investigated and he found this young lady lying down on her seat. The keys were in the ignition because she was running the car to keep warm, this happened to be in the winter months, and he arrested her to DUI. Because, once again, she was in actual physical control of the vehicle because she was behind the wheel, keys in the ignition of the car. If you've been charged with a DUI, time is of the essence. You need to call an attorney who is experienced, who's been through what you're going through, and that person is me -- Matt Nebeker, Mr. DUI." Matthew L. In this video, Matt Nebeker, a DUI Defense Lawyer in Salt Lake City, discusses if you should take the breathalyzer. "If the officer requests you to submit to a breath test – and this is out in the field, a portable breath test – I would not submit to it. I would politely and kindly tell the officer that you don’t believe in the accuracy of that test, however you would gladly submit to a chemical test. The officer will know what that means. A chemical test is a test given with an intoxilyzer machine, a urine test, or a blood test. Absolutely tell him you’ll submit to a chemical test. If you’ve been charged with a DUI, time is of the essence.
