Hello and thank you for joining us today at the Butler Blog. As always, I am your host, Allen Butler, Managing Director of The Realty Butler LLC and agent of West USA Premier Properties. Today I want to examine some of the issues and strategies involving loan delinquency, mortgage default, and foreclosure affecting Arizona’s families. For nearly everyone being affected by this foreclosure crisis, the foundation is almost always negative equity and financial hardship: If financial hardship comes, and you can’t sell the house because it’s “upside down,” you are likely about to stop, or have already stopped, paying your mortgage. This is when the process of foreclosure begins. It is absolutely critical that you know the process and timelines of delinquency, default, and foreclosure, and what your options are in dealing with them. The entire foreclosure process starts with your first missed payment. Let’s take a look at the timeline. When you miss your first payment, you will likely start getting all kinds of communication from your bank. They want to know where their money is, and if you can’t bring your payments current very quickly (usually within 30-90 days), a “notice of default” will be issued. The Notice of Default is a legal notice filed by your bank, indicating they have notified the courts that you are seriously delinquent on the loan. This notice also indicates that if you do not clear the delinquency within 90 days, the property will be scheduled for public auction. When the home is scheduled for public auction, a Notice of Trustees Sale will be posted on the home itself, and filed with the courts. This notice identifies the place and time of the trustees’ sale, the loan servicer and/or legal office pursuing the sale, and the homeowner against whom this action is being taken. The auction date for the trustees’ sale is usually 30 to 90 days after the posted notice date. When and if the property is sold at auction, it now belongs to someone else, usually the lender who filed the action. The next step in the process is eviction. Once the home has transferred ownership at the trustees’ sale, the new owner is going to take possession. Sometimes, the lender will contact the occupants of the home, and offer a “Cash for Keys” deal in exchange for leaving the home within 15-30 days. If the occupant is uncooperative or not able to be contacted, a forcible detainer action will be filed, and eviction proceedings will commence. Now, it is absolutely vital that you understand your “Action Zone.” This is the time during which you can act to contain and mitigate the damage to YOURSELF, your family, your credit, and your future. The Action Zone starts before you even miss a payment, and ends just a few weeks after the Notice of Trustees Sale. It is during this time that you absolutely need to contact someone for help with your situation, as there are several programs in place by lenders, and federal and state governments to help. In our next installment, I’ll discuss these foreclosure prevention programs, how they work, who can do them, and who should do them. SYPNOSIS Mika Tahara has just started high school and yearns to fall in love. However, to her dismay, a gal-like boy in her grade, Nozomu, acquires her cell phone number and begins to make frequent calls. When summer vacation starts, one day, Nozomu drunkenly phones her, but Hiro confiscates the phone and converses with her instead. Although Mika does not know who Hiro is, she feels at ease at the sound of his voice and the two befriend each other. Mika and Hiro agree to meet each other when school starts, and to Mika's shock, Hiro turns out to be the delinquent boy she is afraid of. However, as she understands how gentle he is, they began to fall in love with each other and face a multitude of challenges threatening their relationship, such as Hiro's ex-girlfriend Saki hiring a group of men to rape Mika and continuing to harass her over the phone. An unplanned pregnancy occurs when Mika and Hiro consummate in the school library, and although they are determined to start a family together, a miscarriage brings tragedy to them both. Shortly afterwards, Hiro discovers that his health is deteriorating and makes the painful decision to break up with Mika to keep his terminal illness from causing her pain, but secretly continues to follow her whereabouts through his high school friend, Nozumu. Mika eventually forgets Hiro with the help of Y, her new boyfriend. Through a chance meeting, Hiro's condition is revealed to Mika and she makes a difficult decision to leave Y to go to his bedside. Having Mika back, Hiro is determined to fight his disease and begins to improve. But during a routine checkup, Hiro's condition makes a turn for the worst and he exchanges goodbyes with Mika and his family for the last time. At first, Mika is distraught at his death and even contemplates suicide, but realizes that Hiro would have wanted her to live on.

F*** him up already.” REPORTER: “Now investigators say this video was taken in Ceres and was posted on YouTube.” According to CBS, 33-year-old Jennifer Zuniga posted the video to YouTube herself. But it soon went from viral video- to police evidence. She was arrested and charged with child endangerment and contributing to the delinquency of a minor. But was she encouraging violence or just supporting self-defense? A Gather writer suggests, “Teaching a child self defense as a last resort is a good thing in these violent times, but encouraging a child to beat down and body slam another is reckless and irresponsible, not to mention just plain cruel.” And a TrueCrimeReport writer agrees...saying, violence is OK sometimes- but definitely not in this case. “Sometimes it's good for a young boy to fight. But it must entail a righteous motive -- like honor, defense of self or another, or simply to let people know that you're no longer to be messed with...But we're pretty sure 33-year-old Jennifer Zuniga adheres to no higher calling. She's just mom trash.” But on a BoxingScene**** forum, one commenter says throwin’ fists is better than pullin’ triggers. “That's how it used to be. You squabbed it out, instead of hidin behind a trigger...As far as I'm concerned (by just reading) she did what every parent oughta do when disputes between young men go beyond words. Let um scratch it out in the front yard; fair and square.” A good Samaritan eventually broke up the fight- but police haven’t been able to identify that person by using the video. You are not in the collection business...in fact you rarely, if ever, will have contact with the delinquent property owner. In fact, in one state, Florida, it is even illegal for you to contact the property owner. To sum it all up. You send your money to the taxing jurisdiction when you buy a tax lien. The taxing jurisdiction (city or county) collects the delinquent taxes from the property owner and sends you a check. You are not a debt collector in any way at all.
