This Helicopter causes his own problem during in-flight re-fueling.
Yes, it will probably be contributed to pilot error, however, if you watch the basket during the IFR, you see it drop drastically. That was caused by either wind shear or poor piloting of the refueling aircraft. I doubt the pilot of the helo gets dinged for it.

If there was turbulence (and I believe there was based on the action of the tanker) the helo’s training would have been to ease back on the stick and add a little collective so the basket can stabilize. This is very important with helo’s over fixed wings because of the forward attitude they have to fly to keep speed up. Inexperienced pilots transitioning from fixed wing to rotor tend to error by focusing on the basket too much. If they follow it down, they get caught in the predicament of having the basket moving towards the rotors risking catastrophic problems. Once he nosed down further to follow the basket (or didn’t pull back slightly to counter the air), it was pretty much all over. Either the refueling line was going to hit the rotors or he was going to have to risk his own probe by pulling up sharp. I’m sure the helo pilot will get dinged some for it, but not grounded.

A possible fix would seem to install a weight approx 15-20ft or more, up line fm the basket would probably steady that line a little more and even make the fuel line in a "L" shape, might make it easier to dock w/---???

The CH53 has an operating celing of of 12,450 feet so it is unlikely it is going to encounter a non-tropospheric event is it? Don't try and be such a smartass.
