Attorney Nicholas Warywoda of Parker Waichman gives an example of the type of opening statement an attorney would use in a medical malpractice case.
A doctor’s basic function in a post-surgical visit is to ensure you have not suffered from any complications or further injuries due to your procedure. The doctor needs to do a thorough examination and follow up on any pain you may be having.
Our client went through one such post-surgical visit but the doctor ignored his complaints of pain, failing to do even a basic blood workup. As a result, our client developed a serious infection and succumbed to death after nearly a year of pain after the surgery.
During trial, our opening statement explained to the jury our client’s complaints and how the doctor failed to give reasonable and accepted care to his patient. We showed that the doctor had the opportunity to catch what at that time was a simple infection, before it spread throughout his body and caused his organs to fail.
