$1 Felony: Florida Man Could Go to Jail for Stealing McDonalds Soda

One Naples man is accused of stealing $1 worth of soda from a Florida McDonalds, and now he could face up to five years in prison if he is convicted of the charges. According to the Naples Daily News, 52 year old Mark Abaire filled a courtesy cup with soda on Thursday from the McDonalds soda fountain, and was arrested by police after he refused to pay. Police now say he faces a felony thrift charge. Abaire asked for a water cup around 10 pm, and even though he was told by an employee it was strictly for water, he proceeded to fill it up with soda and sit outside the restaurant. A manager confronted him, asked him to pay, and when the man refused to pay, and also refused to leave the premises, the cops were called. This $1 petty theft altercation was increased to a felony because Abaire has previous petty theft convictions. In Florida, a third-degree felony can result in a sentence of up to five years and a $5,000 fine. It's unclear if the charges will be dropped. Local news reports that Abaire faces additional misdemeanor counts of trespassing and disorderly intoxication.
