Can student loans be discharged in a bankruptcy?
If you have student loans and your debts become burdensome and you’re not able to pay all your debts I’ve got good and bad news.
The good news is there is something that can be done, you can work it out and there are ways to figure it out.
The bad news is the general rule of thumb is that student loans are protected from bankruptcy and you can’t bankrupt out of them. But that doesn’t mean that it’s never been done. There are circumstances and you can actually kind of make an appeal to the creditor and basically ask for leniency. You can say “hey my circumstances are special for whatever reason” and ask for the ability to discharge that debt. It can be done.
I’m not going to tell you how likely that is, that’s not my job. My job is just to simply tell you that can be done. Talk to a bankruptcy lawyer and see what your options are.
The alternative, if you can’t, if they’re non-dischargeable, then you can file a Chapter 13 and you can actually pay them back on a schedule that works within your income.
